Generally, property and debts acquired while married are deemed marital property and may be divided in the divorce, regardless of which spouse's name is on the title. Separate property or debt is not divisible in the divorce and includes property and debt which was acquired before the marriage, was an inheritance or gift from a  third party, is excluded by a valid agreement, or is directly traceable to separate property.


When awarding the family home, the court may grant possession to the custodial parent in an effort to provide continuing stability with regards to the minor children. Towards this end, the court may order either or both spouses to pay the mortgage or expenses for the family home.


If the couple is unable to divide their property and debts, it will be determined by the court. When determining how the marital estate will be distributed, the court takes into consideration the following factors: (1) the number of years of marriage; (2) how much each spouse contributed both monetarily and otherwise to the family's well-being; (30 the assets and debts of each spouse, including how they were acquired; (4) what caused the demise of the marriage; (5) the age of each spouse and their physical and mental capabilities; (6) whether alimony or use of the family home will be awarded to one spouse; and (7) any other factors the court considers necessary to achieve an equitable distribution of the marital estate.

FACT:   The U.S. Census Bureau reports that 30.8 % of all marriages end in divorce.
FACT :  Regardless of what the involved parties say, all of these divorces are, at least in some degree, traumatic for them.
FACT:  "Self Doubt" is an understandable and significant feeling in divorce. As much information as possible is power to individuals involved in divorce.
FACT: When a marriage ends, spouses and their children frequently face huge stressful events such as relocation (new living arrangements), new parenting arrangements and schedules, decisions about marital property, family maintenance and money, etc.
FACT: The extreme and conflicting emotions caused by these severe changes can make it quite difficult for spouses to understand the rather complicated legal process of the divorce action and process, and frequently makes it difficult for the parties to make sound decisions.

For example, consider the following tips:

(1)  Remember:  There are no winners and losers in divorce, only "survivors" and "victims".  Divorce is not a game or sport; it is an unfortunate life experience. Treat it as such, and seek to survive this process. Having an experienced and competent attorney representing you can be very helpful in this process.
(2)  Do not make important decisions about your divorce without thinking them through very carefully and discussing them with your attorney. As my beloved parents used to teach me: "Measure twice, cut once."
(3) Remember: It is you and your spouse who are getting the divorce, NOT YOUR CHILDREN.
Spare your children from hearing the venom and anger you may have towards your spouse. In fact, try to spare your children the pain and aggravation and harsh feelings --- period.
(4) Beware of  "rubberneckers", "gawkers",  self-professed (though untrained) "advisors", etc. These people are generally worth what you are paying them; which , hopefully, is nothing. Quite simply, do not believe everything other people are telling you who have divorced( and particularly be even more cautious about the advice of those who have not divorced) . In over 30 years of very successfully representing clients in divorce actions, I have observed that each and every divorce is unique in many ways.
(5) Despite the pain, the past is past. Despite the trauma, the present is just the present. Plan and prepare yourself  ( and your children, if any) for the future.. Seek out the "Big Picture".

Legal and practical considerations involving DUI or sobriety checkpoints present complex "blurred lines" law enforcement due process  issues. On the one hand, according to the Supreme Court of the United States (SCOTUS), has ruled that DUI checkpoints are a legal and valid law enforcement tool
[ Michigan Dept. of State Police v. Sitz, 496 U.S. 444 (1990)].  On the other hand, police DUI or sobriety checkpoints are not without restrictions, and consequently must be implemented by rules.
For example:

(1) DUI or Sobriety Checkpoint Plans Must Be Vetted and Submitted in Advance for Approval.
     The purpose here is to insure that proper legal standards are followed by officers.

(2) Breathalyzer Tests Can Only Be Administered if there is "Reasonable Suspicion " that the   suspect is intoxicated. Breathalyzer tests administered without legally particularized suspicion are a clear violation of a person's 4th Amendment rights, and thus illegal.

(3) DUI or Sobriety Checkpoint stops must be RANDOM. Police simply cannot pick-out certain cars they want to stop, detain and question, or use any subjective standard for the stop. Arbitrariness is forbidden and is therefore unlawful.

         BALTIMORE  PLUMBISM  (LEAD POISONING) :  WHERE ARE WE NOW ?              

Plumbism in Baltimore has been reduced substantially over the last 40 years or so.

During that time, lead-based paint has been banned from the residential housing market (since 1978), and it has been largely relegated to outdoor use as early as the 1950s; improvements have been made in drinking water, food, plumbing, playgrounds, toys, jewelry, home remedies, etc.; and the elimination of lead-based gasoline --- causing a dramatic reduction in children's blood lead levels.

Over the last 20 or so years the Centers for Disease Control (CDC) has lowered its safe-exposure measure from 25 micrograms (mcg) per deciliter to 10 mcg. Even under this new lower level, however, no more than 1.6 % of young children fall above the CDC threshold in Baltimore --- an encouraging 98 % reduction fro the late 1970s.

The good news is that plumbism(lead poisoning) is steadily decreasing in Baltimore.
